Estate Planning

A will that says exactly what you want

Name who inherits, who carries out your wishes and who raises your children.

A last will and testament is the foundation of most estate plans. It lets you decide who receives your property, who will serve as executor to carry out your wishes, and, if you have minor children, who will raise them. Without a will, New York law makes those decisions for you.

What it covers

Who inherits

Direct specific gifts and the remainder of your estate to the people and causes you choose.

Who is in charge

Name an executor you trust to gather assets, pay debts and distribute what remains.

Who raises your children

Nominate guardians for minor children so a judge isn't choosing from strangers.

Testamentary trusts

Hold an inheritance for a child or a loved one who needs help managing money until the time you choose.

A will is a good fit if you

  • Have minor children and want to name their guardians
  • Want a clear, legally recognized statement of your wishes
  • Have modest assets or assets that already pass by beneficiary designation
  • Are starting your plan and may add a trust later

Common questions

Does a will avoid probate in New York?

No. A will must be admitted to probate in Surrogate's Court before your executor can act. Probate can take months, becomes part of the public record and involves court fees. A trust may help some families avoid it.

What happens if I die without a will?

Your estate passes under New York's intestacy law to your closest relatives in a fixed order, and the court appoints an administrator and, if needed, a guardian for minor children. Your own preferences are not considered.

How often should I update my will?

Review it after any major life change: marriage, divorce, a birth, a death, a move, or a significant change in assets. Our estate planning services include complimentary reviews every three years.
