Guidance for executors and families after a loss

Help settling a loved one's estate through probate or administration.

When someone passes away, their executor or family must gather assets, pay debts and taxes, deal with the Surrogate's Court and distribute what remains. We guide executors, administrators and trustees through each step so the process moves forward correctly and with as little stress as possible.

What it covers

Probate

Admitting a will in court and obtaining letters testamentary so the executor can act

Administration

When there is no will, petitioning for letters of administration and distributing the estate under New York law.

Trust administration

Helping successor trustees carry out the terms of a trust, account to beneficiaries and transfer assets.

Settling the estate

Notifying creditors, handling tax matters, resolving disputes and making final distributions.

We can help if you

  • Were named executor in a will and don't know where to start
  • Lost a family member who had no will
  • Are a successor trustee responsible for a trust
  • Are a beneficiary with questions about an estate

Common questions

How long does probate take?

An uncontested probate often takes several months from filing to distribution, and longer if there are creditor issues, real estate to sell, tax returns to file or disputes among heirs.

What does an executor have to do?

An executor locates and secures assets, files the will with the court, notifies heirs and creditors, pays valid debts and taxes, keeps records and distributes the estate according to the will. We handle the court filings and guide you through the rest.

Do I have to go through probate at all?

Not always. Assets held in a trust, jointly owned property and accounts with beneficiary designations pass outside probate. Small estates may qualify for a simplified voluntary administration. We'll review what applies to your family.
