Choose who speaks for you if you can't
Authorize someone you trust to handle your finances if you become unable to.
A durable power of attorney names an agent to manage your financial and legal affairs if you cannot, whether because of illness, injury or absence. Without one, your family may need to petition the court for a guardianship, an expensive and public process, just to pay your bills or manage your accounts.
What it covers
Banking and bills
Access accounts, pay expenses and manage day-to-day finances on your behalf.
Real estate and investments
Handle property, retirement accounts and investments according to your instructions.
Benefits and taxes
Deal with insurance, government benefits and tax filings when you cannot.
Tailored authority
Grant broad or limited powers, effective immediately or only upon incapacity, with the gifting provisions you choose.
Everyone over eighteen should have one, especially if you
- Own property or have accounts in your sole name
- Have a spouse or partner who would need access to your finances
- Run a business that must keep operating
- Are planning for aging or a health condition
Common questions
What does durable mean?
A durable power of attorney remains effective even if you later become incapacitated, which is precisely when it is needed most. New York's statutory form is durable unless it says otherwise.
Can my agent do whatever they want?
No. Your agent must act in your best interest and within the powers you grant. You can limit the authority, name co-agents, require accountings and revoke the document at any time while you have capacity.
Does a power of attorney cover medical decisions?
No. Health care decisions are covered by a separate health care proxy. We typically prepare both documents together.

A complimentary Estate Planning Discovery Session helps you understand your options and decide what kind of planning fits your circumstances. A full consultation ordinarily takes about two hours; a short questionnaire and some simple homework in advance make our time together focused and productive.
The session is offered at no charge provided the advance preparation is completed and you honor your scheduled appointment.
There is no obligation to move forward with any legal services.
